Welcome to Murrmur (the “Platform”, “we”, “us”, or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the Murrmur website, services, applications, and tools (collectively, the “Services”).
By creating an account, uploading a project, or placing an order on Murrmur, you (“User”, “Creator”, “Supporter”, or “Customer”) agree to be bound by these Terms, our Privacy Policy, Shipping Policy, and Returns & Refunds Policy. If you do not agree to these Terms, you must not access or use the Services.
1. Definitions & Service Model
- Platform: The web application and services provided by Murrmur.
- Creator (Tinkerer/Builder): A user who uploads project specifications, prototypes, or hardware designs to launch a group ordering campaign.
- Supporter (Buyer/Customer): A user who places an order for a single unit of a project listed on the Platform.
- Group Order / Campaign: A time-bound listing where individual orders are aggregated to reach a Minimum Order Quantity (MOQ) required for manufacturing.
- Minimum Order Quantity (MOQ): The minimum total number of units required by a manufacturer to begin production for a given project run.
Murrmur acts as an intermediary platform facilitating group demand aggregation. We allow individual supporters to order single units of a custom project without paying bulk upfront costs, while aggregating these single orders to execute batch production runs with third-party manufacturers.
2. Account Registration & Eligibility
- Eligibility: You must be at least 18 years of age or the age of legal majority in your jurisdiction to use this Platform. By registering, you represent and warrant that you have the legal capacity to enter into a binding contract.
- Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at security@murrmur.store of any unauthorized access or security breach.
3. Currency and Payment Methods
3.1 Default Currency
- The default operating currency across the Platform is the Indian Rupee (INR / ₹).
- All campaign goals, unit prices, and checkout transactions are calculated and billed in INR. For international users, display prices in non-INR currencies are for informational purposes only; the final charge will be processed in INR or converted at the prevailing exchange rate by your issuing bank/gateway.
3.2 Accepted Payment Methods
We support both Indian and International payment methods through licensed, PCI-DSS compliant third-party payment gateways.
- Indian Payment Methods:
- UPI: Unified Payments Interface (Google Pay, PhonePe, Paytm, BHIM, and bank-specific UPI apps).
- Debit & Credit Cards: RuPay, Visa, Mastercard, and Diners Club issued by Indian banks.
- Net Banking: Major Indian public and private sector banks.
- Digital Wallets: Paytm, Mobikwik, Freecharge, Ola Money, and other supported domestic wallets.
- International Payment Methods:
- International Cards: International Credit and Debit Cards (Visa, Mastercard, American Express, Discover).
- International Gateways: PayPal, Stripe, and other foreign currency gateways integrated into checkout.
3.3 International Transactions & Forex Regulations
- All cross-border payments are subject to compliance with the Reserve Bank of India (RBI) guidelines and the Foreign Exchange Management Act (FEMA).
- Any conversion fees, foreign transaction surcharges, or bank processing fees levied by international card issuers or payment gateways are the sole responsibility of the customer.
4. How Group Ordering Works
4.1 Pre-Orders & Aggregation
- When a Supporter places an order for a project, payment is authorized and charged at checkout.
- Placed orders are pooled into a central batch toward the project’s stated MOQ threshold during the active campaign window.
4.2 Successful Campaigns
- If a project reaches or exceeds its required MOQ within the campaign timeframe, the campaign is finalized, and the aggregated batch is placed into manufacturing.
- Once manufacturing begins, orders are custom-produced and cannot be canceled or refunded except as provided in our Returns & Refunds Policy.
4.3 Unsuccessful Campaigns
- If a project fails to meet its MOQ upon campaign expiry, the campaign is marked unsuccessful.
- In such cases, Murrmur will automatically cancel all associated orders and issue a 100% full refund to each Supporter’s original payment method in INR within 5 to 10 business days.
5. Creator Terms & Intellectual Property
5.1 IP Ownership
- Creators retain 100% ownership of the original intellectual property, CAD files, Gerber files, schematics, and design rights for the projects they upload to Murrmur.
5.2 License to Murrmur
- By launching a project campaign on Murrmur, the Creator grants Murrmur a non-exclusive, worldwide, royalty-free license to display, market, reproduce, and transmit project designs, images, and manufacturing files solely for the purposes of:
- Displaying and promoting the campaign on the Platform.
- Transmitting specifications to manufacturing partners for batch execution.
- Fulfilling orders to Supporters.
5.3 Creator Warranties
- Creators represent and warrant that their uploaded designs do not infringe upon any third-party patents, copyrights, trademarks, trade secrets, or proprietary rights.
- Creators certify that their designs do not contain malicious code, harmful components, or illegal materials.
6. Manufacturing, Timelines, & Deliveries
- Estimated Timelines: Production and shipping dates provided on campaign pages are estimates. Hardware fabrication, component sourcing, and batch assembly may encounter unforeseen delays. Murrmur will provide project updates, but does not guarantee exact delivery dates.
- Product Variations: Due to the nature of custom hardware batch manufacturing, minor cosmetic variations, minor tolerance differences, or equivalent component substitutions may occur between prototype renderings and final production units.
- Shipping & Duties: Supporters are responsible for providing accurate shipping details. International shipments are subject to local customs, VAT, tariffs, and import duties, which must be paid by the recipient upon arrival.
7. Prohibited Content & Projects
Users agree not to upload, launch, or order any project that involves:
- Weapons, firearms, explosives, or military-grade hardware regulated under export control laws.
- Medical devices or healthcare equipment lacking required regulatory approvals.
- Devices intended for illegal surveillance, wiretapping, or network intrusion.
- Counterfeit goods, patent-infringing designs, or stolen schematics.
- Items that violate local or international laws, including RBI or customs prohibitions.
Murrmur reserves the right to terminate any project, suspend accounts, and refund Supporters if a project is found to violate these guidelines.
8. Disclaimers & Limitation of Liability
- “As-Is” Service: The Platform and all manufactured projects are provided on an “as-is” and “as-available” basis without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement.
- Prototypes & DIY Hardware: Many projects on Murrmur are open-source tools, developer kits, or enthusiast prototypes. Supporters acknowledge that items should be used in accordance with creator documentation and safety guidelines.
- Limitation of Liability: To the maximum extent permitted by applicable Indian law, Murrmur, its officers, directors, employees, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or operational downtime) arising from your use of the Platform or products ordered through it.
- Maximum Cap: Murrmur’s total liability for any claim arising out of these Terms or an order shall not exceed the total amount paid by the customer for the specific order giving rise to the claim.
9. Indemnification
You agree to defend, indemnify, and hold harmless Murrmur, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising out of:
- Your violation of these Terms.
- Your infringement of any third-party intellectual property or proprietary rights.
- Any content or project specs you upload to the Platform.
10. Governing Law & Dispute Resolution
- Governing Law: These Terms shall be governed by, construed, and enforced in accordance with the laws of the Republic of India, without regard to its conflict of law principles.
- Jurisdiction: Any legal action, suit, or proceeding arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in India.
- Arbitration: In the event of any dispute or claim arising out of these Terms, the parties shall attempt to resolve the matter amicably. If unresolved, the dispute shall be referred to arbitration in accordance with the Indian Arbitration and Conciliation Act, 1996 (as amended). The arbitration proceedings shall be conducted in English.
11. Modifications to Terms
Murrmur reserves the right to update or modify these Terms at any time without prior notice. The updated version will be indicated by a revised “Last Updated” date at the top of this page. Your continued use of the Platform following any changes constitutes acceptance of those revisions.
